Ranchi, Jharkhand: The Jharkhand High Court has taken a strict stance in the shocking case of HIV-infected blood being transfused to children at the Chaibasa Sadar Hospital. The court has directed the police to immediately register a First Information Report (FIR) in the matter.
Immediate Police Action Ordered
Hearing a writ petition filed by Deepak Hembram, a single-judge bench led by Justice Gautam Kumar Choudhary termed the incident as a case of gross negligence and systemic failure. The court instructed the police to register the FIR without delay and take prompt action. Petitioners were directed to submit their application to the local police station, and the station in-charge was instructed to act on it “immediately.”
Demand for SIT Formation
The court further ordered that a copy of the FIR be provided to the petitioners and filed in court along with an affidavit. The petition had sought registration of an FIR against the alleged medical negligence and serious irregularities at the hospital’s blood bank and requested the formation of a Special Investigation Team (SIT) under judicial supervision.
Five Children Affected
According to the petition, in 2025, five minor children suffering from thalassemia were given HIV-infected blood at the hospital. The children, aged between five and seven years, belong to economically disadvantaged families. The incident has caused severe health, social, and economic distress for the children and their families.
Compensation Declared
The state government has announced a compensation of ₹2 lakh for each child. However, the petition highlighted that this is inadequate, as lifelong treatment will be required for managing a serious illness like HIV, which entails significantly higher expenses.
