Sambhal Violence Case: ASP Anuj Chaudhary Moves High Court Against CJM Order to Register FIR

A major legal development has emerged in the Sambhal violence case linked to the survey of the disputed structure — Shahi Jama Masjid, also referred to as Harihar Temple — as senior police officer ASP Anuj Chaudhary has approached the Allahabad High Court, challenging the order passed by the Chief Judicial Magistrate (CJM) directing registration of an FIR against police personnel.

The violence occurred on November 24, 2024, when a court-mandated survey was being conducted at the disputed religious site. During the operation, a massive crowd gathered, and the situation soon spiraled out of control. Incidents of stone pelting, arson, and firing were reported, plunging the area into chaos.

The clashes resulted in the death of four persons, while 29 police personnel sustained injuries. Following the incident, the district administration launched a stringent crackdown against those accused of instigating the violence.

CJM Orders FIR Against 22 Police Officials

On January 9, 2025, acting on a petition filed by Yameen, a resident of Khaggu Sarai in Sambhal, the CJM court directed the police to register an FIR against 22 police officials, including then Circle Officer Anuj Chaudhary and Inspector Anuj Tomar.

The petitioner alleged that during the survey, police opened fire on the crowd, in which his son Alam allegedly sustained three bullet injuries. He further claimed that due to fear of police action, his son was secretly treated in Meerut.

The CJM’s directive triggered widespread concern within the police department.

High Court Challenge

Confirming the development, Superintendent of Police Krishna Kumar Vishnoi stated that the state government has filed a revision petition in the High Court, seeking cancellation of the CJM’s order to register the FIR.

The matter is currently pending, and a date for hearing in the High Court is awaited.

Separate Petitions by Police Officers

According to media reports, former CO Anuj Chaudhary — now posted as Additional Superintendent of Police in Firozabad following his promotion — along with then Inspector Anuj Tomar, has also filed separate individual petitions through their respective legal counsels, requesting the High Court to quash the CJM order.

Questions Raised Over CJM’s Transfer

The controversy further intensified after the transfer of then CJM Vibhanshu Sudhir, who had issued the FIR order, to Sultanpur. Several advocates submitted memorandums questioning the timing of the transfer, calling it an issue of judicial independence.

At present, Inspector Anuj Tomar is serving as Station House Officer at Chandausi Kotwali, while legal proceedings in the High Court continue.

The case has drawn significant attention due to its legal, administrative, and communal sensitivity, with the High Court’s decision expected to play a crucial role in determining the future course of action.
