Police Custody Beating in Bhind: Court Orders Medical Board, Grants Bail to Accused

Bhind, Madhya Pradesh: A controversial case of alleged police beating in Bhind has prompted the district court to order a fresh medical examination of the accused and release them on bail. The court raised questions about the police investigation and directed an independent medical panel to assess the condition of the accused.

Accused Claim Police Brutality
The accused—Deepak Sharma (48), Abhishek Sharma (20), Vivek Sharma (19), Suresh “Tinku” Sharma (36), and Kallu “Pramod” Sharma (26)—alleged that they were beaten while in custody at the Fup Police Station. Their lawyer, Himanshu Sharma, had demanded the formation of a medical board for an independent investigation.

The accused said they were involved in a dispute over a local accident, during which their mobile phones were allegedly seized. They claimed police picked them up on Friday night and subjected them to physical assault.

Court Confirms Injuries
First-Class Judicial Magistrate Vivek Mal acknowledged that the accused suffered injuries consistent with their claims. According to the medico-legal case (MLC) report by Dr. Tapas Sharma, the injuries of Deepak and Pramod were of a serious nature, corroborating their statements.

Court Questions Investigating Officer
The court also criticized the investigating officer’s understanding of law. Assistant Sub-Inspector Raghubir Singh had reportedly cited the accused’s prior criminal records as justification for their arrest, reflecting a misunderstanding of the distinction between bailable and non-bailable offenses.

Bail Granted
Invoking Section 478 of the Indian Civil Security Code, 2023, which provides for bail in bailable offenses, the court ordered the release of all five accused on personal bonds of ₹10,000 each and a surety of the same amount. They are required to attend all hearings and comply with court orders.
