
Jaipur: The Rajasthan High Court has intervened in the Fagi–Dudu road widening project after the municipality canceled property leases without issuing individual notices, ordering the state government to respond by January 13. The court has also put a temporary stay on any demolition of petitioners’ properties until the next hearing.
The controversy arose when local residents filed a petition challenging the Fagi Municipality’s decision to cancel leases and threaten demolition in the name of road widening and beautification. Justice Anurup Singhi, hearing the matter, has issued notices to relevant authorities, including the Principal Secretary of Urban Local Bodies, Secretary of the Public Works Department, Fagi Sub-Divisional Officer, and the Executive Officer of Fagi Municipality.
Court Seeks Response by January 13
The High Court has directed the officials to submit their responses by January 13, emphasizing that no action should be taken on the petitioners’ properties until further orders. Advocate Laxmikant Sharma Malpura represented the petitioners in court.
Leases Over 60 Years Old
According to the petitioners, they hold valid leases that are nearly 60 years old. Despite this, the Fagi Municipality canceled these leases under Section 73(B) of the Municipal Act by issuing public notices, without serving any individual notice. The municipality also threatened demolition, labeling the properties as encroachments, in order to widen the Fagi–Dudu road.
The High Court’s intervention has temporarily halted the demolition drive, marking a significant development in protecting long-standing property rights amid urban development projects.
