
Sehore, Madhya Pradesh: In a significant intervention, the Madhya Pradesh High Court has ensured the safe return of a woman to her husband’s residence under heavy police protection, addressing her concerns about potential interference from her family.
Court Steps In for Protection
The decision came in the case of a woman from Chhindwara, who expressed her wish to live with her husband but feared unlawful interference from her family. The husband had filed a habeas corpus petition, claiming that his wife was being held against her will by her family.
Woman Presented in Court
A bench comprising Justices Vivek Agrawal and Ram Kumar Chaube summoned the woman to court before passing the order. The woman stated that she wished to live with her husband but sought police protection due to fear of “improper and illegal interference” from her family members.
Police Directed to Ensure Safety
The court instructed the police to escort the woman safely to her husband’s residence in Sehore district. Additionally, the Sehore Superintendent of Police was directed to assess the couple’s security needs and provide adequate protection.
In its brief order, the court noted, “After hearing the woman and being satisfied that she is an adult, as confirmed by the documentary evidence presented by the petitioner, we request the police personnel who have brought the detainee to take her safely to the petitioner’s residence, as the marriage is duly registered and they are lawfully married.”
SP and Local Police Stations Instructed
The court further directed the Sehore SP to evaluate any potential threats and provide appropriate protection. The Barghat Police Station in Sehore was also instructed to respond sensitively and empathetically to any complaints by the couple regarding unlawful incidents.
