Shahdol, MP: In a case highlighting administrative negligence, the Madhya Pradesh High Court has imposed a fine of ₹2 lakh on Shahdol Collector Kedar Singh for wrongful imprisonment of a farmer’s son under the National Security Act (NSA). The victim, Sushant Bais, was confined for over one year and five days, causing immense mental and financial distress to his family.
According to reports, Sushant, who returned to his village Saman, Shahdol, in September 2025, revealed the hardships his family endured during his incarceration. His pregnant wife faced severe mental stress, while his father Hiraman Bais had to take a loan of ₹2 lakh to fight for Sushant’s release. The family, primarily dependent on farming their three-acre land, struggled to manage the mounting expenses.
Impact on Career Prospects
Sushant, a graduate, stated that the wrongful imprisonment effectively destroyed his employment prospects. “Who would employ someone falsely accused under the NSA?” he questioned. He now works with his father on the farm. Married in February 2024, Sushant was jailed in September the same year, while his wife was expecting. Their daughter was born in March 2025, during his imprisonment.
Administrative Oversight
Former MP DGP S.C. Tripathi described the incident as “purely a case of administrative negligence.” Sushant’s father had petitioned that the Shahdol SP sent a report to the Collector on 6 September 2024, recommending NSA action. The Collector then issued the NSA order on 9 September without recording any independent witness statements.
While the High Court’s fine penalizes the administrative error, human rights activists and senior police officials note that the emotional and financial suffering endured by Sushant and his family cannot be fully compensated.
This case underscores the critical need for due diligence and accountability in applying stringent laws like the NSA, to prevent undue harm to innocent citizens.
