
Ahmedabad, January 16, 2026: In a shocking case, the Gujarat High Court has rejected the anticipatory bail plea of a Gurugram-based businessman accused by his wife of forcing unnatural sexual acts and repeatedly raping her during their marriage. The allegations also include dowry-related harassment, with the complaint lodged at the Ahmedabad DCB Crime Branch.
According to the complaint, the woman accused her husband, mother-in-law, and father-in-law of demanding dowry and subjecting her to harassment. She alleged that her husband forced her into unnatural sexual acts and repeatedly engaged in sexual relations against her will. Additionally, she claimed that her father-in-law attempted molestation, and her husband remained silent instead of protecting her.
Court Observations:
Hearing both sides, Justice D. A. Joshi emphasized that marital ties do not grant anyone the right to violate another person’s bodily autonomy. The court noted, “Intimate relations are only acceptable when based on consent and mutual respect. Non-consensual acts not only inflict physical harm but also cause serious mental and emotional trauma.”
The marriage, according to the complaint, took place in 2022. It was the woman’s first marriage, while the accused was remarried. The complainant stated that the accused’s first wife had made similar allegations, highlighting a pattern of abusive behavior. The businessman claimed the accusations were baseless and motivated by marital discord, presenting himself as a prominent Gurugram entrepreneur. The wife’s lawyer strongly opposed bail, stressing the seriousness of the alleged offenses.
Considering the gravity of the allegations, the pattern of prior complaints, and the potential threat to the victim, the High Court denied anticipatory bail. The ruling underscores that consent and bodily autonomy are paramount, even within a marriage, and that repeated abuse cannot be excused as a private or domestic matter.
