
Greater Noida, Uttar Pradesh – The Uttar Pradesh government has filed a petition to withdraw the case related to the Bisahda incident, aiming to restore communal harmony in the region. The petition was taken up today in the Fast-Track Court, where the Assistant District Government Counsel (Criminal), acting under the direction of the government and the Joint Director of Prosecution, submitted the application seeking approval for case withdrawal.
Court Proceedings
During today’s hearing, the prosecution requested additional time to respond, following which the court scheduled the next hearing for December 18, 2025.
Government Decision and Legal Process
The decision to withdraw the case was issued by the Department of Justice-5 (Criminal), Uttar Pradesh, on August 26, 2025. Subsequently, the Joint Director of Prosecution, Gautam Buddha Nagar, directed the District Government Counsel (Criminal) to take necessary steps on September 12, 2025. The Governor granted approval for the termination of prosecution, in accordance with Section 321 of the Criminal Procedure Code (CrPC). The formal application was submitted to the court on October 15, 2025.
Background of the Bisahda Incident
On the night of September 28, 2015, in Bisahda village under Jarcha police station, a violent mob attacked a house following rumors of beef consumption. Local resident Akhlaq was beaten to death, and his son Danish was seriously injured.
Akhlaq’s wife, Ikraman, filed an FIR against ten named accused. The case was registered under Sections 147, 148, 149, 307, 302, 323, 504, 506, 427, 458 IPC and Section 7 CLA.
Evidence and Charges
Initial statements identified 10 accused, which later expanded to include 16 more names based on witness testimony. Akhlaq’s daughter, Shahista, named 16 individuals in her Section 164 CrPC statement on November 26, 2015, while Danish identified 19 individuals on December 5, 2015. The investigation officer filed the chargesheet against 18 accused on December 22, 2015. Currently, all accused are out on bail, and the case remains at the evidence presentation stage.
The government’s petition to withdraw the case is seen as an effort to promote social harmony while continuing to follow due legal process in the court.
