The Punjab and Haryana High Court strongly criticized the Haryana government for initiating disciplinary action against a doctor who did not stand up to greet an MLA during COVID emergency duty. The court termed the action “disturbing” and imposed a ₹50,000 fine on the state government.
Show-Cause Notice for Not Standing Before MLA
The case pertains to Dr. Manoj, a Casualty Medical Officer posted in a government hospital under the Haryana Health Department. During the peak of the COVID-19 pandemic, while he was attending to patients in the emergency ward, an MLA visited the hospital. When the doctor did not stand up upon the legislator’s arrival, the government issued a show-cause notice to him.
Dr. Manoj clarified that he did not recognize the MLA, and there was no intention to insult anyone. However, his explanation was ignored and disciplinary proceedings were proposed.
High Court’s Sharp Remarks
The High Court expressed deep concern over the state’s approach. The Bench observed:
- It is “highly troubling” to expect a doctor on emergency duty to leave his patients and stand to greet a politician.
- Initiating action on such grounds reflects insensitivity on part of the administration.
- The doctor’s clarification was not only reasonable but should have been respected.
Calling the action arbitrary and unjustified, the Court reprimanded the government for misusing its authority.
Order to Issue NOC for Higher Studies
Dr. Manoj had approached the High Court as he was being denied the No Objection Certificate (NOC) required for pursuing his postgraduate medical education. The court directed the Haryana government to immediately issue the NOC, enabling him to continue his academic career without administrative obstruction.
The ruling is being widely viewed as a strong message against unnecessary political interference in professional duties, especially in sensitive areas like medical emergencies.
