Delhi High Court Orders Removal of Social Media Posts Linking Dushyant Kumar Gautam to Ankita Bhandari Murder Case

In a significant development in the Ankita Bhandari murder case, BJP leader Dushyant Kumar Gautam has been granted a major relief by the Delhi High Court. The court directed that all defamatory content associated with Dushyant Kumar Gautam, which had been posted by various social media handles, including those belonging to Congress and the Aam Aadmi Party (AAP), be removed within 24 hours.

The Case Against Defamation

Dushyant Kumar Gautam approached the Delhi High Court seeking legal recourse against what he claimed were false and defamatory allegations linking him to the high-profile Ankita Bhandari murder case. Gautam filed a petition that included Congress, AAP, and several others, accusing them of posting baseless claims on social media, tarnishing his reputation without any substantial evidence. The court has recognized these claims as potential defamation and ordered the removal of all objectionable posts and videos linking Gautam to the case.

The court also made it clear that any further attempts to falsely associate Gautam with the murder case would lead to severe legal consequences for those responsible.

The Allegations and Court’s Relief

In his petition, Dushyant Kumar Gautam argued that his name was being unnecessarily dragged into the case, which he stated was causing irreparable harm to his reputation. He claimed that various social media accounts linked to political parties like Congress and AAP had spread false information, accusing him of involvement in the murder case.

The court, after reviewing the case, ruled in Gautam’s favor, stating that without any substantial proof, dragging an individual’s name into a serious criminal case constitutes defamation. As a result, the Delhi High Court issued an order directing social media platforms to take down all related posts within 24 hours.

Court’s Strong Remarks

In its order, the Delhi High Court emphasized that the act of associating an individual’s name with a high-profile criminal case without any concrete evidence is a clear violation of that person’s rights and causes irreparable damage to their reputation. The court further warned that any non-compliance with its orders could lead to strict legal action against the involved parties.

Gautam’s Legal Team’s Argument

Senior Advocate Gaurav Bhatia, representing Dushyant Kumar Gautam, argued that his client’s reputation had been severely damaged by the false and unfounded accusations circulating on social media. Bhatia stated that these accusations were not just harmful but also politically motivated, aiming to use Gautam’s name for partisan gains. He also demanded a compensation of Rs 2 crore for the damage caused to Gautam’s reputation.

Bhatia pointed out that accusations, such as those made by a woman named Urmila, who claimed that Gautam had been involved in VIP services and even murder, were entirely baseless. He further stressed that the spread of such false information by a major political party, like Congress, with millions of followers, had the potential to cause much greater harm than individual claims.

The Role of Social Media in the Case

Bhatia also highlighted the role of social media, particularly Instagram and Twitter, where the posts had already reached millions of people, potentially spreading misinformation to a large audience. He referred to an Instagram reel that had been widely shared, causing further damage to Gautam’s image.

The court was informed that while individual posts by social media users could be damaging, the influence of national political parties with significant online followings magnified the harm caused. The legal team argued that if the political parties had any evidence to substantiate their claims, they should have approached the authorities instead of resorting to social media to defame Gautam.

Court’s Final Ruling

After hearing the arguments, the court ordered the immediate removal of all posts and videos linking Dushyant Kumar Gautam to the Ankita Bhandari case. The court made it clear that any further defamatory content linked to Gautam would be subject to severe legal consequences.

The court also emphasized the need for accountability in handling information on social media and warned against the reckless use of such platforms to harm individuals’ reputations.

Conclusion

This ruling by the Delhi High Court is a significant step in protecting individuals from defamatory content on social media, especially when it involves serious criminal allegations. It serves as a reminder of the potential legal consequences for spreading false information without evidence, particularly when it involves public figures and influential political parties.
