
New Delhi: Emphasizing the importance of a mother’s touch for a sick child, the Delhi High Court has granted 90 days’ interim bail to a woman accused in a fraud and forgery case. Justice Girish Kathpalia approved the bail application of the woman, identified as Sandhya, on the condition that she furnish a personal bond of ₹10,000 and a corresponding surety before the relevant court.
Court’s Observations
The court noted that the allegations against the applicant are limited in nature, and it cannot overlook the fact that a child of such a young age requires not just medical care but also the comforting presence and physical touch of their mother for recovery. “Considering the minimal charges against the applicant, I cannot deny the child the mother’s physical presence, especially during her illness,” Justice Kathpalia stated.
Case Background
The woman faces charges under BNS Sections 318(4)/336(3)/340(2)/338/61(2)/3(5) registered at the Rajouri Garden Police Station in connection with fraud and forgery. She sought interim bail on the grounds that her two-year-old daughter is unwell. The prosecution opposed the bail, arguing that the child has other relatives capable of providing care.

The High Court highlighted that the child’s health and well-being is a paramount consideration. It emphasized that the minor’s need for her mother’s care and comforting presence could not be ignored, especially given the limited scope of the charges against the accused.
