
New Delhi: A civil court in Delhi has taken a strict stance against officials of the Municipal Corporation of Delhi (MCD) for allegedly ignoring court orders. Senior Civil Judge Animesh Bhaskar Mani Tripathi of Saket Court has issued a notice to the Deputy Commissioner (DC) of MCD, demanding an explanation at the next hearing. The court warned that if a proper status report is not submitted by the next date, the DC will be required to appear personally in court.
Case Background:
The case pertains to a property dispute. On 2 December 2025, the court had ordered written explanations from the Executive Engineer (EE), Assistant Engineer (AE), and Junior Engineer (JE) regarding the disputed property. Submission of these explanations through the MCD DC was mandatory.
Violation of Court Orders:
During the hearing on 17 February 2026, the court observed that the submitted status report contained only the signatures of the AE and JE. No separate explanation was filed by the EE, and the report was not forwarded by the DC as required. The court deemed the report incomplete and invalid and refused to record it.
Defense Arguments Rejected:
The defense argued that the previous court stay, issued on 29 October 2025, was based on MCD’s earlier report and that the additional construction on the property was “compoundable,” with assurances from the owner to rectify it. The judge rejected this argument, stating that until the 2 December 2025 order is fully complied with and a correct status report is submitted, the interim stay will remain in effect.
Court’s Strict Directive:
The court has directed the MCD Deputy Commissioner to either submit a proper report or appear personally in court during the next hearing on 18 April 2026. The Executive Engineer and Assistant Engineer are also required to be present. The interim stay on the property will remain effective until the next hearing.
