Gavai Regrets Lack of Consensus on Woman Judge for Supreme Court During His Tenure

New Delhi: India’s outgoing Chief Justice B.R. Gavai on Sunday expressed regret that no woman judge could be recommended to the Supreme Court during his tenure. He clarified that although several women candidates were considered, the collegium could not reach a consensus on any of the names.

Responding to a question, Justice Gavai strongly rejected allegations of nepotism within the collegium system, calling such claims “misplaced and incorrect.”

“No Pressure From the Executive”

Justice Gavai emphasized that he never faced pressure from the executive at any point.
He noted that several decisions during his term went against the government, including his very first judgment related to the extension of the ED Director’s tenure.

“The government appears as a party before the court,” he said. “But that does not mean every verdict will go against it or in its favour. Decisions must rest solely on merit.

Remarks on Presidential Reference

On the issue of Presidential Reference, the CJI reiterated that courts cannot add words to the Constitution, and therefore cannot specify a timeline for the President or Governors in clearing pending files.

Pollution in Delhi-NCR: Long-Term Action Needed

Asked why pollution levels in Delhi–NCR remain largely unchanged despite multiple court orders, Justice Gavai stressed the need for long-term, sustained efforts.

“It should not be that concerns are raised only around Diwali,” he said, highlighting the importance of consistent policy action rather than seasonal outrage.
