
New Delhi: The Supreme Court of India on Tuesday emphasized that it is the responsibility of political leaders to promote brotherhood and uphold constitutional values in the country. The observation came while hearing a public interest petition seeking guidelines for political speeches.
Bench Refuses to Entertain Current Petition
A bench led by Chief Justice of India (CJI) D.Y. Suryakant declined to hear the petition, asking the petitioners to file a fresh, impartial plea. The petition, filed by senior lawyer Kapil Sibal, was prompted by allegations of hate speech by Assam Chief Minister Himanta Biswa Sarma. The court noted that the petition appeared to target specific individuals, making it unacceptable in its current form.
Call for Impartiality
CJI Suryakant stated, “A petition targeting selected individuals will not be entertained. Any challenge must be fair, impartial, and objective.” Sibal clarified that the petition was not intended against any single individual and agreed to remove references to Sarma, seeking the court’s consideration on broader issues of political accountability. Justice B.V. Nagarathna added that restraint from all parties is essential.
Background and Previous Appeals
The Supreme Court had earlier urged politicians to exercise restraint in Assam, emphasizing adherence to constitutional ethics, mutual respect, and dignity. CJI Suryakant remarked, “We are a 75-year-old mature democracy. While elections can be fought on ideological grounds, respect is non-negotiable. These standards must apply equally to all parties.”
Debate on Guidelines
Justice Nagarathna observed that political leaders must actively foster national brotherhood, but also raised concerns about enforcing guidelines and regulating speech. She emphasized that ideas must evolve in accordance with constitutional values, rather than being imposed arbitrarily. The bench directed the petitioners to file a fresh petition, leaving the door open for further debate and potential guidance on political speech in the coming days.
