Supreme Court Set to Hear Petition Against Kuldeep Singh Sengar’s Bail in Unnao Rape Case


The Supreme Court of India is scheduled to hear the Central Bureau of Investigation’s (CBI) petition challenging the Delhi High Court’s order that suspended the life imprisonment sentence of former BJP MLA Kuldeep Singh Sengar in the infamous Unnao rape case. The hearing is expected to commence shortly before a three-judge bench comprising Chief Justice Surya Kant, Justice J.K. Maheshwari, and Justice Augustine George Masih.

CBI’s Stand

In its petition, the CBI has cited the Supreme Court’s verdict in the L.K. Advani case, which clarified that individuals holding public office, including Members of Parliament and legislators, are considered public servants. The agency argues that the Delhi High Court erred in stating that Sengar, who held office as a legislator at the time of the crime, could not be classified as a public servant.

The Delhi High Court suspended Sengar’s life sentence on December 23, noting that he had already served seven years and five months in prison. Sengar had challenged the 2019 conviction pronounced by the lower court. The High Court’s decision to grant bail has sparked widespread debate and criticism.

Public Reaction

The suspension of Sengar’s sentence has triggered protests in Delhi, particularly at Jantar Mantar, where the Unnao victim, her family, and activists voiced their dissent. The victim emphasized the urgent need for enhanced security measures for her family, highlighting ongoing concerns over safety and justice.

The Supreme Court’s forthcoming hearing is being closely watched, as it will determine whether the High Court’s suspension of Sengar’s sentence stands or is overturned, marking a crucial moment in one of India’s most high-profile criminal cases.
