Maulana Mahmood Asad Madani Welcomes Allahabad HC Verdict, Calls for Halt to Illegal Actions Against Madrasas

New Delhi: Maulana Mahmood Asad Madani, President of Jamiat Ulama-e-Hind, has welcomed the historic verdict by the Allahabad High Court concerning independent and non-affiliated religious madrasas. He described the judgment as a clear victory for the supremacy of the Indian Constitution and constitutional values.

Speaking on the ruling, Maulana Madani said it sends a strong message to all governments and administrative authorities that have attempted to shut down madrasas and maktabs as a measure of achievement. Such steps, he added, were not only unconstitutional but ultimately embarrassing for those implementing them.

He highlighted that Jamiat Ulama-e-Hind had represented 30 madrasas from Shravasti district in the Allahabad High Court and had also been engaged in a legal and democratic struggle against the approach of the Uttarakhand government. The High Court ruling, he said, strengthens these efforts. He also urged madrasa administrators to continuously improve their internal management and educational standards, leaving no room for criticism.

The Maulana noted that the High Court had clearly stated that a madrasa cannot be closed, sealed, or prevented from functioning solely on the grounds of lacking official recognition. The court further clarified that the Uttar Pradesh Madrasa Rules contain no provision allowing the administration to shut down non-affiliated madrasas.

Moreover, the verdict reaffirmed the constitutional principle upheld by the Supreme Court that minority educational institutions which neither receive government aid nor seek recognition are fully protected under Article 30(1) of the Constitution.

Maulana Madani appealed to all state governments, including Uttar Pradesh, to review their policies in line with the High Court ruling and Supreme Court principles, and to immediately refrain from any arbitrary, illegal, or discriminatory actions against madrasas.

He emphasized that Jamiat Ulama-e-Hind will continue to protect the educational, religious, and civil rights of minorities within the constitutional framework. On this occasion, Maulana Madani also appreciated the lawyers and madrasa representatives for their patience, perseverance, and legal efforts, congratulating them on this success.
