
The release of Thalapathy Vijay’s much-anticipated film Jana Nayagan has been pushed further into uncertainty after the Madras High Court declined to deliver a final ruling on the matter. On Tuesday, the court’s Division Bench set aside the earlier order passed by a single judge directing the Central Board of Film Certification (CBFC) to grant certification, and referred the case back to the Single Bench for fresh consideration.
The Division Bench, comprising Chief Justice Manindra Mohan Shrivastava and Justice G. Arul Murugan, observed that the censor board must be given adequate time and due process to present its stand before any directive on certification is issued. As a result, Jana Nayagan remains uncertified and cannot be released in theatres for now.
Directed by H. Vinoth, the film was originally scheduled to hit screens on 9 January 2026, but the CBFC did not issue a certificate even after recommending certain cuts. Earlier, Single Judge Justice P.T. Asha had directed the board to grant a U/A certificate, noting that the suggested edits had already been implemented by the makers. However, the Division Bench had stayed that order the same day, leading to the current legal deadlock.
In its latest ruling, the High Court clarified that certification authorities cannot be compelled to grant clearance in haste, especially when objections are still under examination. The bench emphasized that the censor board should be allowed sufficient opportunity to respond, rather than being bound solely by its earlier recommendations for cuts.
The controversy stems from a complaint filed by a CBFC board member, following which the film was sent back to a revising committee. The complaint alleged that certain scenes in Jana Nayagan could potentially hurt religious sentiments and portray the armed forces in an unfavorable light. Notably, the complaint was raised by a member who had earlier been part of the panel that initially cleared the film with cuts.
After the Division Bench stayed the single judge’s order, the film’s producer KVN Productions approached the Supreme Court, challenging the interim stay. However, the apex court dismissed the plea and directed the makers to pursue the matter before the Madras High Court instead.
With the case now sent back for a fresh hearing before the Single Bench, a new round of legal proceedings is set to begin. Until a final decision is taken and a censor certificate is granted, the theatrical release of Jana Nayagan will remain on hold.
The film is particularly significant as it is being described as Thalapathy Vijay’s final film before he shifts focus full-time to politics with his party TVK. Apart from Vijay, Jana Nayagan also stars Pooja Hegde, Bobby Deol, Mamitha Baiju, Gautham Vasudev Menon, Prakash Raj, Narain, and Priyamani, making it one of the most high-profile Tamil releases awaiting clearance.
